Injury Check – Website and Mobile App

Applies to: the website www.injurycheck.info and the Injury Check mobile app for Android (Google Play) and iOS (App Store — coming later)


1. About this policy

Injury Check ("we", "us", "our") helps people in Queensland who have been injured in a car crash (CTP), at work (WorkCover) or in a public place (public liability) to understand their options and, if they want, to be connected with a partner law firm. We have been helping injured people since 2001.

This policy explains how we collect, use, disclose, store and protect your personal information when you:

  • visit or use our website, www.injurycheck.info (the Website);
  • download or use the Injury Check mobile app (the App); or
  • contact us by phone, email, SMS, live chat or social media.

We comply with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs).

By using the Website or App, you acknowledge that you have read this policy. Where we need your consent (for example, to collect health information or to share your details with a law firm), we will ask for it clearly and separately.

2. Important: we are not a law firm

Injury Check is not a law firm and does not give legal advice. We help you work out whether you may have a claim and, with your consent, refer you to an independent partner law firm. Any legal advice comes from the law firm, which will handle your personal information under its own privacy policy and professional obligations.


3. Quick summary

  • The App has no accounts and no login. Your diary, checklists, photos and saved location stay on your phone. We can't see them.
  • The only App information that reaches us is a Free Claims Check enquiry that you choose to send.
  • Injury and health details are sensitive information. We only collect them with your consent.
  • You choose which law firm your details go to. With your separate consent, we send your enquiry only to the law firm you choose, so it can contact you about your claim.
  • The App has no ads, no analytics, no crash reporting, no push notifications and does not use your advertising ID.
  • We do not sell your personal information.
  • To see, correct or delete information you have sent us, email info@injurycheck.info.

4. What personal information we collect

4.1 Through the Website

When you use our claims check or contact forms, live chat, phone, email or SMS, we may collect:

  • Identity and contact details — your name, phone number, email address, postal address and date of birth.
  • Accident and claim details — what happened, when and where, the type of claim (for example CTP, WorkCover, public liability or superannuation/TPD), vehicle registration numbers, police report number, insurer or policy details, claim numbers, employer and occupation details, superannuation fund details, and whether you already have a lawyer.
  • Health and injury information — your injuries, previous injuries, symptoms, treatment, and the doctors, specialists and physiotherapists you have seen, and any reports you provide. This is sensitive information under the Privacy Act.
  • Photos and documents — photos or documents you choose to upload (for example of your injuries, the accident scene, vehicle damage or medical reports). Photos of injuries are health information.
  • Communications — messages you send us, chat transcripts and notes of phone calls.

4.2 Through the App

Information that stays on your device. The App is designed to work without sending your information to us. The following is stored only on your device and is never sent to Injury Check or anyone else unless you choose to include it in a Free Claims Check enquiry:

  • diary entries and checklists;
  • photos, videos and audio you record in the App, and references to media you select from your library;
  • an incident location you choose to save; and
  • your language choice.

No account is created. The App has no sign-up, login or user account, so we do not hold an App account for you.

Information you choose to send us (Free Claims Check enquiry). If you decide to send a Free Claims Check enquiry from the App, it includes:

  • your name, phone number and email address;
  • the date of the incident and your description of what happened (which may include health and injury information); and
  • for motor vehicle claims, vehicle registration numbers and any photos you choose to attach.

Nothing is sent until you review your enquiry and choose to send it.

What the App does not collect. The App does not include analytics, crash reporting or advertising tools. It does not collect your advertising ID, does not show ads, does not send push notifications, and does not track your location in the background. We do not receive usage data about how you use the App.

4.3 Information from other people

Sometimes we receive information about you from someone else — for example a family member, friend or support person who contacts us on your behalf, or a partner law firm updating us on whether they were able to help. If someone gives us information about you, we will handle it under this policy. If you give us information about another person (for example a witness or another driver), please make sure they know you are doing so.

You don't have to give us your information, and you can use a first name only or a pseudonym for general enquiries. However, if you don't give us your contact and injury details, we may not be able to assess your situation or refer you to a law firm.


5. App permissions

The App only asks for a permission when you use the feature that needs it. You can refuse or withdraw any permission at any time in your device settings; the rest of the App will still work.

Location — while using the App only (precise and approximate) Only when you tap to record where an incident happened. The location is saved on your device and used to open it in your maps app. It is never tracked in the background and is only included in an enquiry if you choose to add it. You can type the location in yourself.
Camera To take photos and videos of your injuries and the accident scene. You can still use the App and send an enquiry without photos.
Photos and media library To attach photos or videos you already have. Only the items you select are used. You can still use the App and send an enquiry without attachments.
Microphone To record sound when you record a video. You can record video without sound, or take photos instead.

The App does not ask for access to your contacts, notifications or general device storage. It does not access your camera, microphone, photos or location in the background, and it does not scan your photo library.


6. Health information and your consent

Injury and health information, including photos of injuries, is sensitive information. We will only collect it if you agree.

Before you send us any health information or photos, the App and our Website forms will ask you for two separate consents. Neither box is ticked for you:

  1. Consent to collect: you agree to us collecting the injury and health information and photos you choose to give us, so we can check whether you may have a claim.
  2. Consent to refer: you agree to us sending your details, including your health information and photos, to the law firm you choose, so it can contact you about your claim.

You can give the first consent without the second. If you don't agree to the referral, we won't share your details with any law firm.

We only ask for health information that is reasonably necessary to understand your injury and your potential claim, and to refer you to a law firm that can help. We may also collect health information where the law otherwise permits or requires it.

You can withdraw your consent at any time by contacting us (see section 18). Withdrawing consent won't affect anything we did before you withdrew it. Information already sent to a law firm with your consent is held by that firm under its own privacy policy, but we will tell the firm you have withdrawn consent if you ask us to.


7. Collection notice

Before you submit your details through the App or a Website form, we show you a short notice. It tells you:

  • Who we are: Erhard Gregory Englhofer trading as Injury Check, contactable at info@injurycheck.info.
  • Why we collect it: to check whether you may have a personal injury claim and, with your consent, to refer you to a partner law firm.
  • Who we share it with: the law firm you choose (only with your consent), and service providers who help us run our business (see section 9).
  • What happens if you don't provide it: we may not be able to help you or make a referral.
  • Overseas storage: some of our service providers may store data outside Australia (see section 10).
  • Sensitive information: we ask for your separate consent before collecting health information or photos, and again before sending them to the law firm you choose.
  • Your rights: you can access and correct your information and ask us to delete it — this policy explains how.
  • Complaints: you can complain to us, and then to the OAIC if you're not satisfied.

8. How we use your personal information

Enquiries are handled the same way whether they come from the Website, the App, email or phone. We use your personal information to:

  • respond to your enquiry and contact you by phone, SMS or email;
  • assess whether you may have a claim and whether we can help;
  • with your consent, refer you to the law firm you choose;
  • follow up with you and with the law firm about the status of your referral;
  • operate, maintain, secure and improve the Website and the App;
  • keep records of our dealings with you and of the consents you have given;
  • manage our relationships with partner law firms;
  • send you information about our services, but only where you have agreed or where the law allows — you can opt out at any time (see section 12); and
  • comply with our legal obligations and respond to lawful requests.

We do not:

  • sell your personal information;
  • use your health information for advertising or marketing; or
  • share App information with advertising networks or build advertising profiles.

9. Who we disclose your information to

9.1 Partner law firms

You choose the law firm. Before anything is sent, you pick the law firm you want your details to go to, or we show you the firm and you agree to it. Only then, and only with your consent, do we send that one firm your contact details, accident and claim details, health and injury information and any photos or documents you provide, so it can contact you and consider your claim. We never send your details to a firm you haven't chosen, or to several firms at once. If you later want to try a different firm, we will only send your details to it once you have chosen it and given your consent again.

Injury Check does not receive any fee, commission or other benefit from a law firm for referring you. You are free to choose any lawyer you like, and you don't have to use a firm we refer you to.

Once a law firm receives your information, it is responsible for handling it under its own privacy policy and legal obligations. If you are unsure which firm received your details, contact us and we will tell you.

9.2 Service providers

We use trusted third parties to help us run our business. They handle your information only to provide their services to us. These include:

  • App enquiries: when you send a Free Claims Check enquiry, the App opens your own email app with a message addressed to info@injurycheck.info. You can review the message before you send it, and it is sent through your own email provider under that provider's terms. If we start using a third-party form service to receive App enquiries, we will update this policy to name it and say where it stores data.
  • Website and email hosting: our Website and our info@injurycheck.info mailbox are hosted by DreamHost, a United States company (see section 10). Incoming email is filtered for spam and security by MailChannels on DreamHost's behalf.
  • Website platform and forms: our Website runs on WordPress with page-builder and form plugins (including Contact Form 7), which process the details and photos you submit through our forms. Form submissions are checked for spam using Akismet (Automattic).
  • Live chat: we use Tidio for live chat on the Website. If you use the chat, Tidio processes your messages and related technical information. See Tidio's privacy policy at https://www.tidio.com/privacy-policy/.
  • Professional advisers: such as our accountant, insurers and lawyers, where needed.

The App itself has no back-end server and does not use any analytics, crash reporting or advertising services.

9.3 Other disclosures

We may also disclose your personal information:

  • to someone you have authorised to act for you;
  • where required or authorised by law, a court or a government agency;
  • where we reasonably believe it is necessary to lessen or prevent a serious threat to someone's life, health or safety; or
  • as part of a sale or restructure of our business, where the buyer agrees to handle your information in line with this policy.

10. Overseas disclosure and cloud storage

Information stored only on your device in the App is not sent to us or overseas.

Some of the service providers we use store or process personal information outside Australia. Based on the providers we currently use, your information is likely to be stored or accessed in the United States (website and email hosting with DreamHost), and in Poland and other European Union countries (Tidio live chat).

Before we use an overseas provider, we take reasonable steps to make sure it handles your information consistently with the Australian Privacy Principles, including through its contract terms and security commitments. We remain responsible under the Privacy Act for how these providers handle your information on our behalf.

The App has no back-end server. The only App information we receive is an enquiry you choose to send by email, which arrives in our DreamHost-hosted mailbox.

Our partner law firms are all based in Australia, and we do not send your details to law firms outside Australia.


11. Cookies and chat on our Website

Cookies are small files stored on your device when you visit a website. Our Website and our service providers use cookies and similar technologies to:

  • make the Website work properly (for example forms, spam protection, language selection and page features); and
  • provide live chat (Tidio).

If you reach our website through a link or QR code from one of our partner businesses, we store a small first-party cookie (ic_ref) for up to 90 days recording which business referred you, so we can note the referral source on your enquiry. It contains no personal information and is not used for analytics or advertising. No payment is made for referrals.

We do not use website analytics, and we do not use advertising or remarketing cookies.

You can block or delete cookies using your browser settings. If you block cookies, some parts of the Website (such as live chat or forms) may not work properly.

The App does not use cookies, analytics or tracking technologies.


12. Direct marketing

We will only send you marketing messages (for example, updates about our services) where you have agreed or where the law allows. Every marketing email or SMS will include a simple way to unsubscribe, and you can also opt out by contacting us. We will never use your health information for marketing, and we will not give your details to other businesses for their own marketing.

Messages about your enquiry or referral (for example, a follow-up call about your claim) are not marketing.


13. How we protect your information

In the App: information in the App stays on your device and is protected by your phone's standard security, such as your screen lock and the device encryption built into Android and iOS. The App does not add its own extra encryption, so please use a screen lock and keep your device secure. Anyone who can unlock your phone may be able to see what you have saved in the App.

Enquiries you send us, and Website data: we take reasonable steps to protect personal information from misuse, interference, loss, and unauthorised access, change or disclosure. These include:

  • using encrypted connections (HTTPS/TLS) for our Website and forms;
  • limiting access to personal information to people who need it;
  • protecting our accounts with passwords and other access controls;
  • choosing service providers with appropriate security measures; and
  • securely deleting or de-identifying information we no longer need.

No method of transmission or storage is completely secure, so we can't guarantee the security of your information. If a data breach is likely to result in serious harm to you, we will notify you and the Office of the Australian Information Commissioner (OAIC) as required by the Notifiable Data Breaches scheme.


14. How long we keep your information

On your device (App): App information stays on your device until you delete it in the App or uninstall the App. We never have a copy unless you send it to us in an enquiry.

Enquiries we receive (from the App, Website, email or phone), including any photos you attach: we keep these only as long as we need them for the purposes in this policy, or as required by law. As a guide:

  • Enquiries that are not referred to a law firm: deleted or de-identified within 12 months.
  • Referred enquiries: kept for up to 7 years after the referral, to meet record-keeping and legal obligations.
  • Chat transcripts: kept for 12 months.

When we no longer need your information, we take reasonable steps to destroy or de-identify it.


15. Deleting your data

App — no account to delete. The App does not create an account, so there is no App account to delete. Your App information is only on your device, and you control it:

  • Delete individual items: delete diary entries and other items in the App at any time.
  • Delete everything on this device: use the option in the App's Settings to delete all your data on this device.
  • Uninstall: uninstalling the App removes all App data from your device.

Enquiries you have sent us (App or Website). Deleting or uninstalling the App does not delete an enquiry you have already sent us. To ask us to delete it, email info@injurycheck.info with the subject "Delete my data", using the email address or phone number you gave us so we can find your records. You can do this at any time, even without the App installed.

What happens next:

  • We will confirm your request, and may need to verify your identity before acting on it.
  • We will delete the personal information we hold about you (including photos, health information and messages) within 30 days.
  • We may need to keep limited information where the law requires it or for legitimate purposes, such as records of referrals, records of your consent, or to deal with a legal claim. In that case we keep only your name, the date of your enquiry or referral, the law firm you chose and the record of your consent, for up to 7 years. We will tell you if this applies.
  • Deleted information is removed from our backups as they are overwritten, within 90 days.
  • Information already given to a law firm: the law firm holds its own copy under its own privacy policy. At your request, we will tell the firm you have asked for deletion and give you its contact details so you can contact it directly.

16. Accessing and correcting your information

You can ask for a copy of the personal information we hold about you, or ask us to correct it if it is inaccurate, out of date, incomplete, irrelevant or misleading. Email info@injurycheck.info or use the other details in section 18. (We don't hold the information stored in the App on your device — you can view and change that yourself in the App.)

We will respond within 30 days. We won't charge you for making a request, but may charge a reasonable fee for providing access in some cases (we'll tell you first). If we refuse your request, we will explain why in writing (unless it would be unreasonable to do so) and tell you how to complain.


17. Children

The Website and App are intended for adults aged 18 and over. We do not knowingly collect personal information directly from anyone under 18. If a child has been injured, a parent or guardian should contact us on their behalf. If you believe someone under 18 has sent us personal information, please contact us and we will delete it.

How we handle complaints: please tell us what happened and how you would like it resolved. We will acknowledge your complaint within 7 days and aim to respond in full within 30 days.

19. Changes to this policy

We may update this policy from time to time, for example when we add new features to the App or change service providers. The latest version will always be available at https://www.injurycheck.info/privacy-policy/ and linked from the App, with the "Last updated" date at the top. If we make a significant change to how we handle your personal information, we will let you know through the App or the Website, and ask for your consent again where required.


20. Third-party websites and services

The Website and App may contain links to other websites or services, such as partner law firms, government agencies, maps apps or social media. We are not responsible for the privacy practices of those websites or services, and we encourage you to read their privacy policies.
